PUBLIC HEARING TITLE: FEMA Endangered Species Act (ESA) Compliance Code Amendments / DCA2025-00001
Proposal: The City is proposing development code and municipal code amendments to the Area of Special Flood Hazard regulations. The amendments to the development code are necessary to incorporate regulatory changes required by the Federal Emergency Management Agency (FEMA) as they relate to the Endangered Species Act (ESA). These regulatory changes are required in order for the City of Tigard to continue participation in the National Flood Insurance Program (NFIP). The proposed amendments include:
- Updates to Municipal Code Chapter 9.10 that add new definitions and no net loss standards; and
- Updates to Chapter 18.510, Sensitive Lands, to require a no net loss analysis with a sensitive lands review for development within areas of special flood hazard.
Zone: All zones with Areas of Special Flood Hazard
Approval Criteria: Statewide Planning Goals 1 (Citizen Involvement), 2 (Land Use Planning), 7 (Areas subject to Natural Hazards); METRO’s Urban Growth Management Functional Plan Titles 3, and 8; Comprehensive Plan Goals 1.1.2, 2.1.1, 2.1.2, 2.1.3, 2.1.11, 2.1.20, 7.1.4, 7.1.5, 7.1.7, 7.1.8, 7.1.9, 7.1.11, 7.1.14, and 11.1.1; and Tigard Development Code Chapters 18.790.
PROVIDING TESTIMONY: To provide testimony at the hearing, call 503-966-4101. The automated recording will ask for your name and contact information. You will then be placed in the queue to provide testimony. The hearing will start with staff and applicant presentations. Then the Planning Commission will open the public testimony portion of the hearing and at this time you will be able to provide testimony to the Planning Commission. The staff person will take you out of the queue to provide testimony. Testimony will be taken in order of the phone calls received. If you would like to testify, you must call in between 7:00 PM and 7:30 PM to get into the phone queue for public testimony.

PUBLIC COMMENTS: Written public comments may be submitted electronically. All comments must be received before 4:30 PM on the day of the hearing. Testimony may also be provided during the hearing.
