Behind the Scenes
New Zoning and Design Standards for Downtown
On January 26, 2010 the City Council adopted new zoning and design standards for the Downtown Urban Renewal Area. These land use regulations and zoning map changes will promote well-designed new development in the Downtown and assure the viability and continuation of existing businesses. This new code also implements the vision in the Tigard Downtown Improvement Plan (TDIP) of a vibrant, pedestrian oriented urban village in Downtown Tigard.

Overall goals of New Zone: Mixed Use- Central Business District (MU-CBD)
  • Encourage the Downtown to transition to the community vision of the Tigard Downtown Improvement Plan (TDIP) over time with new development.
  • Ensure the quality, attractiveness, and special character of our Downtown as the "heart" of Tigard.
  • Balance the need to foster the viability of existing development and businesses with the public policy goal of an attractive, pedestrian-oriented downtown.
Summary of Proposed New Zone: Mixed Use- Central Business District (MU-CBD)

Includes all properties in the Urban Renewal District, currently zoned Central Business District (CBD), General Commercial (C-G), Commercial Professional (C-P), and Residential-4.5 (R-4.5).

  • One list of permitted uses throughout the zone.
  • A wide range of uses allowed, similar to existing CBD zone.
  • For the most part, uses that are "Not Permitted" under current zoning continue to be "Not Permitted."
  • Some existing "Permitted" uses are not considered to be consistent with the TDIP. In most cases those uses have been proposed to be "Restricted" uses rather than "Not Permitted."
  • The distinction is that a "Restricted" use is considered conforming, but no further uses of this kind are permitted in the zone.
Four Design Sub-Areas
  1. Highway 99W/ Hall
  2. Main Street/Center Street
  3. Commercial/Scoffins
  4. Fanno/Burnham
The sub-areas are similar to, but distinct from, zones in that they deal with development standards, such as building height and setbacks.
Existing Structures/Uses/Businesses
  • Can continue, or expand, on the existing tax lot.
  • Allow additions to, and renovations of, existing buildings (including nonconforming structures), as long as the new project conforms to applicable design regulations.
  • Maintenance, repair, and interior remodeling does not require additional land use /design review.
  • If destroyed or abandoned, can be re-established within one year.
Flexible Approval Process
For new buildings or renovation projects requiring review, there are three alternate paths to review:
  • Track 1, "Design Compliance Letter" used for specified renovation projects.
  • Track 2, used for larger renovation projects and new building construction meeting clear and objective standards.
  • Track 3 process provides the opportunity for well-designed projects which cannot meet the clear and objective standards for building and site design. Project must be reviewed by a Design Review Board.
