Proposed Code Amendments
The City of Tigard Community Development Code identifies development code amendments
as a "Type IV" procedure. Type IV procedures apply to legislative matters.
Legislative matters involve the creation, revision, or large-scale implementation
of public policy. Type IV matters are considered initially by the Planning Commission
for the purpose of making a recommendation to the City Council, with final decisions
made by the City Council.

A Comprehensive Plan and Zoning Map Amendment, Lot Line Adjustment, and a Minor Modification to the existing Jackson Business Center site to accommodate the loss of parking to the Business Center when the School District condemned a portion of the site for a new access to Durham Elementary. The applicant proposes adjusting the common lot line to transfer 3,153 square feet from the School District to the Business Center and changing the Medium Density Residential (R-12) zone to Industrial Park (I-P). The area will be developed with 10 parking spaces for the Jackson Business Center.

A Comprehensive Plan Map and Zoning Map Amendment to change the Comprehensive Plan Designation and Zoning Classification for three parcels (approximately .98 acres) from Low Density Residential (R-4.5) to Mixed Use Residential - 1 (MUR-1). The site is located on the east side of Hall Boulevard between Hunziker Street and Knoll Drive, within a small pocket of R-4.5 zoning. Sites on the west side of Hall Blvd. are zoned Central Business District (CBD). All three parcels of the site are within the Downtown Urban Renewal District.

located east of Hall Boulevard at the dead end of Wall Street. Surrounding
properties are zoned I-L to the north and south, R-12 to the west, and I-P
to the east across the railroad tracks.

To remove section 18.775.070.B.5 of the
Sensitive Lands Permit requirements which reads "5. The plans for the pedestrian/bicycle
pathway indicate that no pathway will be below the elevation of an average annual
flood;". Removal of this section would allow pathways to be installed in areas
which would benefit the public (access to and educational appreciation of
ecological areas). Removal of this requirement does not affect the protection
of sensitive habitats or floodplain requirements.

A Comprehensive Plan Map Amendment to correct the City's Significant Wetlands and Stream Corridors Map in the vicinity of SW Dartmouth and Hwy 217. The Tigard City Council approved the Tri-County Shopping Center proposal (Comprehensive Plan Amendment (CPA) 98-0002/Site Development Review (SDR) 98-0002/Planned Development Review (PDR) 98-0001/Sensitive Lands Review (SLR) 98-0002/Lot Line Adjustment (MIS) 98-0004), which approved a Comprehensive Plan Amendment to the Water Resources Overly District, including fill and mitigation of a approximately 1.41 acres of existing wetlands on the property, and other development. The resource maps were not revised as indicated in the findings for the decision. Meanwhile, Army Corps of Engineers and Department of State Lands permits were obtained and grading, filling and mitigation occurred even though the remainder of the development was not built. The Significant Habitat Areas map, based on the wetland inventory, is also in error and needs revision accordingly. Although Council's approval of CPA98-00002 legally amended the City's Significant Wetlands Map, the Director's application is to formally correct the error in mapping.

The City of Tigard proposes to amend Comprehensive
Plan Policy 10.2.1. This amendment was directed by City Council in Resolution 07-13
on March 13, 2007. It provides explicit language that annexation is required before
property within its Urban Services Area, but outside the City limits, can receive
city services. These changes also ensure that all policies in the Comprehensive
Plan are consistent with City and County Agreements. The proposed amendments to the
policy are specified on the attached form. |
